1. Overview
This Acceptable Use Policy ("Policy") governs access to and use of Hyper AI Charts, the HyperCharts website, dashboards, indicators, market narrative tools, AI-assisted research features, data views, newsletters, summaries, APIs, affiliate-gated areas, DarkHerd-related surfaces, and related services (collectively, the "Service").
The Service provides financial market narrative analysis, sentiment dashboards, cryptocurrency and market indicators, backtests, forecasts, AI-assisted summaries, research interfaces, and related market-information tools. The Service may include delayed public data, live or restricted data for approved users, affiliate-gated access, and experimental features.
By using the Service, you agree to comply with this Policy. This Policy applies together with the Terms of Service, Privacy Policy, Disclaimer, Subscription & Purchase Terms, Commercial Disclosure under Japanese Law, and any other terms presented in connection with the Service.
2. Permitted Use

- using affiliate-gated functions only under the access rules stated by the Service;
- submitting authorized account, contact, Telegram, or affiliate verification information where requested;
- contacting the operator through the stated contact channel;
- exporting or deleting your account data where such controls are available.
3. No Financial Misuse
The Service is not a broker, dealer, exchange, investment adviser, financial adviser, commodity trading adviser, portfolio manager, crypto-asset exchange service provider, custody provider, or execution venue.
You must not use the Service:
- as a substitute for independent financial, investment, tax, legal, or professional advice;

- to avoid legal, regulatory, tax, exchange, broker, or platform obligations.
4. Market Abuse, Fraud, and Manipulation
You must not use the Service to plan, facilitate, promote, conceal, or conduct:
- market manipulation;
- pump-and-dump activity;
- wash trading;
- spoofing;
- layering;
- front-running;
- insider trading;
- misuse of material non-public information;
- fraudulent investment schemes;
- deceptive promotions;
- false or misleading performance claims;
- unauthorized solicitation of investments;
- money laundering;
- sanctions evasion;
- terrorist financing;
- unlawful gambling or betting;
- tax evasion;
- exchange rule violations.
5. System Abuse and Security Interference
You must not:
- attempt to gain unauthorized access to accounts, admin areas, APIs, databases, logs, credentials, secrets, systems, queues, infrastructure, affiliate records, or restricted data;
- bypass, disable, or interfere with authentication, authorization, password controls, affiliate gating, rate limits, audit logs, IP controls, role controls, or security features;
- probe, scan, test, or exploit system vulnerability without written authorization;
- overload, disrupt, degrade, or interfere with the Service or its infrastructure;
- upload, submit, transmit, or link malware, ransomware, spyware, exploit payloads, corrupted files, parser attacks, prompt-injection payloads, or harmful code;
- manipulate API calls, browser state, request headers, sessions, client code, or data feeds to access restricted functionality;
- use the Service to test harmful prompts, evasion methods, automated exploitation, credential attacks, or security bypasses without written authorization.
6. Unauthorized Automation and Extraction
You must not:
- scrape, crawl, index, copy, mirror, bulk download, or extract data from the Service without authorization;
- use bots, scripts, automated workflows, headless browsers, or bulk access methods in a way that exceeds permitted use;
- reverse-engineer, decompile, disassemble, or attempt to extract source code, prompts, models, embeddings, algorithms, backtest logic, trading logic, strategy parameters, infrastructure details, security logic, or non-public system behavior;
- use the Service or its outputs to build a competing product, model, data feed, dataset, signal service, or research product without written permission;
- resell, sublicense, redistribute, publish, or commercially exploit the Service, Service data, derived indicators, or restricted outputs without written permission.
7. User Content and Input Restrictions
You are responsible for all content, data, identifiers, messages, files, prompts, API keys, exchange-related information, Telegram messages, affiliate information, notes, and other materials you submit to the Service ("User Content").
You must not submit User Content that:
- you do not have the right to submit or process;
- infringes intellectual property, privacy, publicity, confidentiality, trade secret, contractual, exchange, or platform rights;
- contains unlawful, abusive, harassing, threatening, defamatory, obscene, exploitative, or discriminatory material;
- contains another person's personal data without a lawful basis or required consent;
- contains confidential exchange, broker, employer, client, issuer, project, or third-party information that you are not authorized to process;
- contains material non-public information intended for trading advantage or unlawful dissemination;
- contains malware, hidden payloads, parser attacks, corrupted structures, or prompt-injection content;
- is intended to corrupt, overload, bias, manipulate, or falsify AI outputs, charts, summaries, backtests, rankings, heatmaps, forecasts, or dashboards.
8. Exchange, Affiliate, and Third-Party Rules
If the Service uses or references Bybit, Telegram, AI providers, market-data providers, hosting providers, payment providers, blockchain networks, exchanges, or other third-party services, you must comply with the applicable third-party terms, policies, and legal requirements.
You must not:
- submit false or misleading Bybit UID, trading-volume, affiliate, account, API, or verification information;
- use another person's exchange UID, credentials, API keys, account data, or Telegram identity without authorization;
- misrepresent your eligibility for affiliate-gated or restricted access;
- use the Service to violate exchange rules, broker rules, platform rules, market-data licenses, or API terms;
- attempt to obtain live or restricted data without approval.
9. AI Output Misuse
AI-generated outputs, summaries, forecasts, indicators, sentiment scores, market narratives, backtests, and chat responses may be incomplete, inaccurate, stale, biased, experimental, or affected by data limitations, model limitations, retrieval limits, prompt context, provider availability, or system degradation.
You must not:
- present AI outputs as guaranteed facts, financial advice, investment recommendations, trading instructions, professional opinions, or verified predictions;
- remove uncertainty language, risk warnings, context, dates, assumptions, data limitations, or provenance in a way that misleads others;
- publish Service outputs as your own regulated research, investment advice, or performance marketing without required review, authorization, and disclosure;
- use outputs to make automated decisions for other persons in financial, credit, employment, insurance, housing, legal, healthcare, or other high-impact contexts.
10. Public Communication and Promotions
You must not use the Service name, outputs, screenshots, charts, signals, backtests, or forecasts in public communications that are false, misleading, deceptive, incomplete, or likely to create unjustified reliance.
You must not state or imply that:
- the Service guarantees profits, returns, win rates, loss avoidance, or forecast accuracy;
- the operator endorses your trading, fund, channel, product, token, exchange, project, or service;
- past backtests or past live results guarantee future performance;
- the Service is licensed, regulated, or registered in a specific capacity unless this is expressly stated by the operator.
11. Account and Access Restrictions
Where accounts are available, you must:
- provide accurate account and verification information;
- keep credentials secure;
- use only your own account unless expressly authorized;
- promptly notify the operator of unauthorized access;
- comply with whitelist, beta, affiliate, admin, usage-limit, and access restrictions.
You must not sell, rent, share, transfer, or assign your account or approved access without written permission.
12. Enforcement
The operator reserves the right to enforce this Policy where necessary to protect users, the Service, third parties, markets, infrastructure, legal obligations, and operational integrity.
Enforcement actions may include:
- monitoring usage where lawful and necessary;
- investigating suspected violations;
- limiting, suspending, or terminating access;
- removing, rejecting, disabling, or deleting content;
- blocking accounts, IP addresses, API calls, or sessions;
- invalidating affected data, outputs, indicators, or derived artifacts;
- imposing rate limits or feature restrictions;
- notifying third parties, platforms, authorities, or affected persons where required or appropriate;
- taking legal action.
The operator is not required to provide prior notice before taking enforcement action.
