Subscription & Purchase Terms

1. Overview

These Subscription & Purchase Terms ("Purchase Terms") apply to any paid features, subscriptions, usage-based services, live insights, research access, newsletters, data access, API access, AI-processing features, affiliate-gated features, or other paid digital services offered through Hyper AI Charts and related websites, dashboards, applications, tools, Telegram channels or groups, and services (collectively, the "Service").

These Purchase Terms apply in addition to the Terms of Service, Privacy Policy, Acceptable Use Policy, Disclaimer, Commercial Disclosure under Japanese Law, and any checkout terms shown before purchase.

If the Service is currently offered only as a beta, pilot, delayed-data dashboard, invitation-only service, affiliate-gated service, or unpaid service, these Purchase Terms apply when paid services are introduced or enabled.

3. Nature of Paid Service

Hyper AI Charts is a market-information and AI-assisted financial narrative analysis service.

Paid services may include access to or increased limits for:

  • live or restricted market insights;
  • market sentiment dashboards;
  • news and YouTube sentiment analytics;
  • altcoin trend heatmaps;
  • summaries and newsletters;
  • HyperOracle research, signals, live-trading displays, and backtest displays;
  • HyperWind forecast or prediction research;
  • Optima price-distribution indicators;
  • Collatz-related indicators;
  • HyperProphet reinforcement-learning validation metrics and backtest charts;
  • DarkHerd market-cap, whitepaper, context-ingestion, and chat-over-context features;
  • data exports;
  • API access;
  • AI-processing features;
  • affiliate-gated features;
  • administrative or team functions;
  • other digital features disclosed at checkout.

Specific paid features, limits, billing intervals, access conditions, and eligibility requirements will be stated before purchase.

4. No Trading, Brokerage, Custody, or Advisory Service

Paid access does not change the nature of the Service.

The Service does not provide:

  • personalized financial advice;
  • investment advice;
  • tax advice;
  • legal advice;
  • accounting advice;
  • brokerage;
  • exchange services;
  • custody;
  • order execution;
  • portfolio management;
  • managed accounts;
  • copy trading;
  • pooled investment products;
  • guaranteed signals;
  • guaranteed returns.

Users remain solely responsible for all trading, investment, tax, legal, compliance, exchange, wallet, API, and risk-management decisions.

5. Merchant of Record and Payment Processing

Payments may be processed by a third-party Merchant of Record or payment provider.

Where a Merchant of Record is used:

  • the Merchant of Record may be the seller of record for transaction purposes;
  • the Merchant of Record may be responsible for billing, payment processing, tax calculation, tax collection, invoices, receipts, payment support, chargebacks, and refund handling;
  • the Merchant of Record's terms and policies may apply to the transaction.

Where a payment processor is used without a Merchant of Record:

  • the operator or another disclosed seller remains the merchant;
  • the payment processor facilitates the transaction;
  • the payment processor's terms and privacy policy apply to payment processing.

Applicable provider details will be disclosed at checkout where required.

6. Pricing and Billing

6.1 Pricing

All prices will be displayed before purchase.

Prices may be shown inclusive or exclusive of taxes depending on provider configuration, jurisdiction, and checkout presentation. Applicable taxes, fees, billing intervals, subscription prices, and total charges will be disclosed before purchase where required.

6.2 Billing Cycle

Subscriptions may be billed on a recurring basis, such as monthly, annually, or another interval disclosed at checkout.

Billing frequency, renewal timing, payment amount, and payment timing will be disclosed before purchase.

6.3 Automatic Renewal

Subscriptions renew automatically at the end of each billing period unless canceled before renewal.

Renewal terms and timing will be disclosed before purchase. By subscribing, you authorize recurring charges until cancellation.

7. Checkout Disclosure

At the final purchase screen, the following information will be presented where required:

  • total price;
  • billing interval;
  • payment timing;
  • automatic renewal conditions;
  • subscription term;
  • cancellation method;
  • refund conditions;
  • service delivery timing;
  • applicable taxes and fees;
  • material feature limits;
  • access eligibility requirements;
  • any other required purchase information.

You must review and confirm these details before completing a purchase.

8. Free Trials, Beta Access, and Affiliate-Gated Access

If a free trial is offered:

  • the trial duration will be stated;
  • included features and limits will be disclosed;
  • conversion to paid subscription will be disclosed;
  • automatic billing after trial will be indicated;
  • cancellation requirements before the trial ends will be stated.

Failure to cancel before the trial ends may result in charges if automatic conversion is disclosed before the trial begins.

Beta access, pilot access, delayed-data access, whitelist access, invitation-only access, and affiliate-gated access may be modified, limited, suspended, revoked, or discontinued at any time unless a paid plan states otherwise.

Affiliate-gated access may require a valid Bybit UID, trading-volume information, access approval, or other eligibility information. Approval of access does not create a financial advisory, brokerage, exchange, custody, or managed-trading relationship.

9. Cancellation

9.1 Cancellation Method

You may cancel a subscription through one or more available methods:

  • account settings;
  • billing portal provided by the payment provider;
  • Merchant of Record account or checkout portal;
  • Telegram @cryptohamsterchannel;
  • another method displayed at checkout.

9.2 Effect of Cancellation

Cancellation stops future billing.

Unless otherwise stated:

  • access to paid features continues until the end of the current billing period;
  • already charged fees are not refunded;
  • downgraded, delayed, free, beta, or restricted access limits may apply after the paid period ends;
  • stored data may remain subject to the Privacy Policy and applicable retention rules.

You are responsible for canceling before renewal if you do not want the subscription to continue.

10. Refunds

10.1 General Policy

Payments are non-refundable except where required by law or expressly stated at checkout.

10.2 Digital Services

Because the Service provides digital content and digital services, refunds may not be available once access is granted, data is made available, AI processing is performed, newsletters are delivered, API access is enabled, or other paid digital features are provided, unless required by law.

10.3 Merchant of Record Cases

If a Merchant of Record is used:

  • refund requests may be handled directly by that provider;
  • the provider's refund policy may apply;
  • refunds may depend on provider rules, legal requirements, and transaction status.

Applicable details will be provided at checkout or through the provider's support channels.

11. Failed Payments

If payment fails:

  • access to paid features may be suspended, restricted, or downgraded;
  • the provider may retry billing;
  • you may be required to update payment information;
  • unpaid amounts may remain due unless canceled or waived;
  • data retention and access may be affected by plan status and applicable policies.

12. Changes to Pricing

The operator may change pricing, plans, limits, access requirements, eligibility requirements, or billing structures at any time.

For active subscriptions, changes will be communicated in advance where required. Continued use after a price change takes effect constitutes acceptance of the changed pricing unless applicable law requires additional consent.

13. Service Changes

Paid features may be modified, replaced, limited, suspended, or discontinued.

No guarantee is made regarding:

  • specific features;
  • uninterrupted availability;
  • storage limits;
  • API limits;
  • live-data availability;
  • AI-provider availability;
  • market-data-provider availability;
  • exchange-provider availability;
  • Telegram availability;
  • signal quality;
  • indicator quality;
  • forecast quality;
  • backtest quality;
  • search quality;
  • newsletter continuity;
  • data accuracy;
  • long-term continuity of any feature.

Where required by law, users will receive appropriate notice of material changes affecting paid services.

14. User Responsibility

You are responsible for:

  • reviewing all purchase and subscription terms before purchase;
  • confirming that the selected plan meets your needs;
  • maintaining accurate billing information;
  • managing your subscription;
  • canceling before renewal if you do not wish to continue;
  • reviewing market information critically;
  • verifying important information independently;
  • obtaining qualified professional advice where needed;
  • complying with laws, regulations, tax rules, exchange rules, broker rules, and platform terms;
  • using the Service in accordance with all applicable policies.

15. No Guaranteed Outcomes

No guarantees are made regarding:

  • trading profits;
  • investment returns;
  • loss avoidance;
  • win rate;
  • signal accuracy;
  • forecast accuracy;
  • backtest repeatability;
  • market timing;
  • liquidity;
  • tax treatment;
  • legal compliance;
  • access to any exchange, affiliate program, or third-party service;
  • suitability for a specific purpose.

AI outputs, market signals, backtests, charts, forecasts, and summaries should be treated as informational research aids only.

16. Limitation of Liability

To the fullest extent permitted by law, the operator is not liable for:

  • subscription-related disputes arising from misunderstanding disclosed terms;
  • indirect, incidental, special, consequential, exemplary, or punitive damages;
  • loss of data, profits, capital, revenue, business, opportunities, goodwill, reputation, or market position;
  • trading losses, investment losses, tax liabilities, liquidation events, margin calls, missed trades, or missed opportunities;
  • losses resulting from use of, inability to use, or reliance on the Service;
  • losses caused by third-party payment providers, Merchants of Record, AI providers, exchange providers, market-data providers, hosting providers, Telegram, or other third-party services;
  • decisions made based on Service outputs.

Nothing in these Purchase Terms limits rights or liability that cannot be excluded under applicable law.

17. Compliance with Laws

These Purchase Terms are intended to support compliance with applicable consumer protection, e-commerce, and digital-service laws, including laws of Japan where applicable.

18. Changes to These Purchase Terms

These Purchase Terms may be updated at any time. Updated versions will be published on the website, inside the Service, or through another reasonable notice method.

Continued use of paid services after an update constitutes acceptance of the updated Purchase Terms where permitted by law.
